Privacy Policy – Bel V

This privacy policy (hereinafter: “Privacy Policy”) governs the processing of your personal data as part of your visit to the website http://belv.be (hereinafter: “Website”) of Bel V (hereinafter: “Bel V, we, us, our”) or your communication with Bel V via e-mail, telephone, fax and social media (hereinafter: “Social Media Channels”; e.g. LinkedIn).

In general

  1. Your personal data are processed by Bel V, Rue Walcourt 148, 1070 Anderlecht, registered in Brussels 0892.419.202, acting in the capacity of controller.

  2. The terms in this Privacy Policy must be interpreted in the light of the General Data Protection Regulation (Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC).
  3. Where reference is made to certain laws or regulations, such reference shall also include any change, replacement or annulment of said laws or regulations, including any related executive decisions.
  4. Bel V reserves the right to modify or amend the Privacy Policy at its own discretion and from time to time. Such modification or amendment shall be communicated via the Website.

 

Types of personal data we process

  1. Whenever you use our Website and Social Media Channels, we collect:
    • technical information associated with the device you use, such as your IP address, browser type, geographical location and operating system and
    • information concerning your browsing behaviour, such as how long you visit, what links you click on, what pages you visit and how many times you visit a page.
  2. When you contact us via e-mail, telephone, fax or our Social Media Channels, we collect:
    • the basic identity information you provide us with, such as your name, e-mail address, postal address, telephone number, the company you work for, your function;
    • the content of your communication and the technical details of the communication itself (with whom you correspond at our end, date and time, etc.);
    • publicly available information of your profile on Social Media Channels and
    • any other personal data you choose to provide to us.
  3. When you fill an contact form on our Website we collect:
    • your basic identity information, such as name and e-mail address;
    • information regarding the subject of your message and
    • all other personal data you provide us with via the space you can freely fill in.

 

Purposes for processing

  1. Bel V processes your personal data in order to respond to your comments and/or questions.
  2. Bel V processes your personal data when necessary to defend itself in judicial or other proceedings.
  3. Bel V processes your personal data in order to comply with legal obligations or to meet any reasonable request from authorized agents or representatives of police, judicial authorities, government authorities or bodies, including competent data protection authorities. Bel V may, on its own initiative, transfer your personal data to the police or judicial authorities as evidence or if there is a legitimate suspicion of an illegal act or crime committed by or through the use of the Website, our Social Media Channels or other communication with us.
  4. Bel V processes your personal data to perform statistical analyses so that we may improve our Website and Social Media Channels.
  5. Bel V may process your personal data for informing any third party in the context of a possible merger with, acquisition from/by or demerger by that third party, even if that third party is located outside the EU.
  6. Bel V may process your personal data for the preservation of the legitimate interests of Bel V, its partners or a third party if and when your use of the Website, Social Media Channels or other communication channels can be considered (a) a violation of any applicable terms of use or the intellectual property rights or any other right of a third party, (b) a threat to the security or integrity of the Website, Social Media Channels or other communication channels, (c) a danger to the Website, Social Media Channels or other communication channels or any of Bel V’s or its subcontractors’ underlying systems due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (d) in any way hateful, obscene, discriminating, racist, slanderous, spiteful, hurtful or in some other way inappropriate or illegal.
  7. Regarding the camera surveillance, we rely on our legitimate interest to protect the security of our company goods and documents and to protect the safety and security of our employees and third parties.

 

Legal basis for processing your personal data

  1. The processing of your personal data for the purposes outlined in articles 3.1, 3.2, 3.4, 3.5 and 3.6 is necessary for the protection of the legitimate interests of Bel V, namely to:
    • respond to comments and/or questions;
    • enable us to defend ourselves in judicial proceedings;
    • ensure the continuous improvement of the Website and Social Media Channels;
    • enable corporate transactions; and
    • protect our Website and Social Media Channels from misuse and illegal activities.
    • protect our company goods and documents and protect the safety and security of our employees and third parties.
  2. The processing of your personal data for the purpose outlined in article 3.3 necessary to allow Bel V to comply with its legal obligations.

 

Specific information regarding camera surveillance

  1. The images of the camera surveillance will solely be stored for a maximum of one (1) month. Except when we need to retain the footage longer, for example in case there is a theft, incident or other suspicious activity recorded.
  2. The camera surveillance are indicated by a pictogram at the entrance to the office building.
  3. There will be no real-time surveillance. Camera footage will only be accessed if there is suspicion of theft or other incidents. Only one person at Bel V will have access to the camera footage.

 

Recipients

  1. Bel V does not send your personal data in an identifiable manner to any third party without your explicit consent to do so. You understand, however, that if you use our Social Media Channels, your personal data is also processed by the social media providers.
  2. Bel V relies on third party processors to provide you the Website as well as to process your personal data on our behalf, such as an IT provider. These third party processors are only allowed to process your personal data on behalf of Bel V upon explicit written instruction of Bel V. Bel V warrants that all third party processors are selected with due care and that they are obliged to guarantee the safety and integrity of your personal data.
  3. Bel V processes your personal data in the first place within the European Economic Area (EEA).
    However, should your personal data be processed outside the EEA, appropriate measures will be taken to protect your personal data.

 

Quality assurances

  1. Bel V does its best to process only those personal data which are necessary to achieve the purposes listed under article 3.
  2. Your personal data are only processed for as long as needed to achieve the purposes listed under article 3 of this Privacy Policy and in accordance with our Retention Policy.
    Bel V will de-identify your personal data when they are no longer necessary for the purposes outlined in article 3, unless there is:

    • an overriding interest of Bel V or any other third party in keeping your personal data identifiable;
    • a legal or regulatory obligation or a judicial or administrative order that prevents Bel V from de-identifying them.
  3. Bel V will take the appropriate technical and organizational measures to keep your personal data safe from unauthorized access or theft as well as accidental loss, tampering or destruction. Access by personnel of Bel V or its third party processors will only be on a need-to-know basis and subject to strict confidentiality obligations. This means that both personnel and external processors are subject to strict confidentiality obligations. However, you understand that safety and security are best effort obligations.

 

Your rights

    1. You have the right to request access to all personal data processed by Bel V pertaining to you. You must always specify the processing activities in respect of which you wish to exercise your right of access.
      Bel V is entitled to charge a reasonable fee based on administrative costs for more copies.
    2. You have the right to ask for the rectification of any inaccurate personal data pertaining to you. If a request for rectification is submitted, such request shall be accompanied of proof of the flawed nature of the data for which rectification is asked.
    3. You have the right to request the erasure of personal data pertaining to you if it is no longer required in light of the purposes described in article 3. However, keep in mind that a request for erasure will be evaluated by Bel V against:
      • Bel V’s overriding interests or any other third party or
      • Legal or regulatory obligations or administrative or judicial orders which may prevent such deletion.

Instead of erasure, you can also ask that Bel V restricts the processing of your personal data if and when (a) you contest the accuracy of that data, (b) the processing is illegitimate or (c) the data are no longer needed for the purposes which are outlined above, but you need your personal data to defend yourself in judicial proceedings.

  1. You have the right to object the processing of your personal data when the processing activity is based on the necessity to pursue our legitimate interest or for the legitimate interest of a third party and if you are in a particular and specific situation that justifies such an objection. You must communicate your situation to us so that we can assess your request correctly.
  2. You have the right to receive from us in a structured, commonly used and machine-readable format all personal data you have provided to us where the processing is based on your consent and if the processing is carried out by automated means.
  3. If you wish to submit a request to exercise one or more of the above rights, you may send an e-mail to our Data Protection Officer using the e-mail address info@belv.be. An email requesting the exercise of a right will not be construed as consent to the processing of your personal data beyond what is necessary to process your request. Any such request must clearly state the right you wish to exercise and the reasons for doing so where required. It must also be dated and signed, and accompanied by a digital scanned copy of your valid identity card proving your identity.
    Bel V will promptly inform you of the receipt of this request. If the request proves valid, Bel V will notify you as soon as possible and no later than thirty (30) days after receipt of the request.
    If you are not satisfied with Bel V’s response, you are free to lodge a complaint with the competent data protection authority, i.e. the Belgian data protection authority.
